The Arizona 10 Day Notice to Cure or Vacate is the first step prior to eviction and is given to a tenant who violated the lease, excluding Non-payment of rent.

If rent is not paid in 5 days. If the tenant did not receive a termination notice and a chance to pay the rent and late fees, or the notice does not comply with the law or was not properly served, the court must dismiss the eviction action. (RPEA 13(a)(2)).

In order for a landlord to evict a tenant, the tenant must have violated their obligations under their lease, such as using the property for an unallowed purpose, or not paying the rent. The landlord may then retake possession of the property after the tenant has violated the terms of the lease.

This legal notice is a formal demand under Arizona law that you either make payment arrangements or move out of the residence and return the keys within five days from the date you received this notice. The Notice to Quit Form is the beginning of the eviction process, and it communicates the intention to initiate eviction proceedings if a tenant does not comply with an order and remains on the premises beyond the specified date.

Once the tenant's notice expires in Arizona, the landlord may file an eviction lawsuit (?Forcible Entry Detainer?) with the court the following business day. Landlords can file in Justice Court for claims under $10,000 (filing fees cost $35) and claims over $10,000 are filed in Superior Court (filing fees cost $218).
