The proof of debt submitted by a creditor may contain details of more than one class of debt i.e. a debt owed to the claimant as a contributory and a separate debt owed to the claimant as a creditor.

Debt collectors have a certain number of years they can sue you and win to collect a debt. It's called the statute of limitations and it usually begins when you fail to make a payment on a debt. In South Dakota, the statute of limitations is six years.

Most negative items should automatically fall off your credit reports seven years from the date of your first missed payment, at which point your credit scores may start rising. But if you are otherwise using credit responsibly, your score may rebound to its starting point within three months to six years.

If you're sure the debt is nothing to do with you, contact the creditor and tell them. If they insist you do owe the debt, ask them to provide proof, for example a copy of the original agreement.
