In North Carolina, nonpayment of rent is the most common ground for eviction. In this case, you are required to give the tenant a 10-day "notice to quit." The notice informs the tenant that they need to pay the rent due within 10 days. Otherwise, they will be evicted.

The landlord must file a ?Complaint in Summary Ejectment? with the clerk of court. In court, the landlord must prove that grounds for eviction exist.

Filing the Documents Take the original and two (2) copies of the Motion to the Civil Division of the Clerk of Superior Court's office in the county where your case is filed.
