The Texas Family Code Section 1.08 states that: "A promise or agreement made on consideration of marriage or nonmarital conjugal cohabitation is not enforceable unless the promise or agreement or a memorandum of the promise or agreement is in writing and signed by the person obligated by the promise or agreement."

Texas cohabitation laws permit cohabitation agreements to contain provisions appointing critical roles. For example, cohabitation agreements may address whether one party may act as conservator of the other if they become incapacitated or make health care decisions for the other in case of an emergency.

Ing to Texas Family Code Section 2.401, common law marriages, also known as cohabitation, is a legal way for couples who are living together to be recognized as legally married under the law. Common law marriages hold the same validity as formal marriages granted by a judge or clergy.

Texas law states that a common law marriage may be proved by evidence that the couple: ?agreed to be married?; and. ?after the agreement they lived together in this state as husband and wife?; and they. ?represented to others that they were married?

Unlike some states, Texas does not recognize common law marriage. This means that simply living together for a certain amount of time does not automatically entitle unmarried partners to the same legal rights and responsibilities as married couples.
