What is the Process for Filing for an Annulment in PA? Either party can file for annulment under 23 Pa. C.S. § 3303, whether the marriage is ?void? or ?voidable.? The process for filing simply requires submitting a request with your local courthouse to annul the marriage.

In Florida, there is no time period after your marriage in which you can get an annulment if your marriage is not working out. If your marriage is not working out and you want to end it, you have to get a dissolution of marriage ? a divorce. An annulment typically involves some type of fraud.

Grounds for annulment are different from the grounds for divorce in Pennsylvania. In PA, an annulment may be granted if your marriage is void or voidable. A marriage is void when state law prohibits it, to begin with, but for whatever reason, you were still able to obtain and file a marriage license.

The Pennsylvania Rules of Civil Procedure require both parties to wait ninety (90) days from the service of the Complaint before filing the consent forms. You must wait ninety (90) calendar days from the date Notice to Defend and Divorce Complaint is served (see Step Two). The date Defendant is served is Day 1 of 90.

Voidable marriages include: one or both spouses were under age 16. one or both spouses were under age 18 and the marriage was performed without parental consent. the marriage was entered into under the influence of liquor or drugs (annulment must be brought within 60 days)
