Failure to Indict: If you are charged with a felony in district court and after 6-months you have not been indicted, you may file for expungement. There is no filing fee. File the ?Failure to Indict? Form in the court you were charged.

The total fee for a felony expungement is $300. A $50 non-refundable filing fee is due at the time the application is filed. If the application is granted, the defendant must pay an expungement fee of $250, which can be made in installment payments. The expungement cannot be completed until the full $250 has been paid.

The following persons can't own a firearm in Kentucky: People with a felony conviction, including youthful offenders, unless they are granted a full pardon or relief. People under 18 years old (except when hunting or with permission of a parent). People who are prohibited from purchasing firearms under federal law.

If you obtain a pardon for your conviction by the Kentucky Governor or President of the United States, your firearm rights may be restored. Under the new expungement laws, those convicted of Class D felonies may be eligible for restoration of firearm rights.

The Kentucky law does not include any federal court charges. The law covers 61 felonies, (see attached list) or about 70% of the available infractions. The law specifically excludes expungement for any violent crimes, sexual offense or for any crimes against children or public corruption.

KRS 431.076 permits the expungement of felony charges originally filed in District Court that have not resulted in an indictment by the grand jury. The expungement petition, AOC-497.2, may be filed no sooner than six months following the date of the District Court decision to hold the matter to the grand jury.
