N.Y. Civil Practice Law and Rules (CPLR) 320(a) provides three ways in which a defendant may appear in an action: (1) serving an answer; (2) serving a notice of appearance; or (3) making a motion which has the effect of extending the time to answer.

What is it? A Notice of Appearance is a document we file alerting the Clerk of Court and all the attorneys in your case that we are representing you as your attorneys. The notice is usually titled ?Notice of Appearance and Designation of Email Address.?

You must fill out the Application for a Pro Se Summons form and submit it to the clerk in the county where you are suing, along with payment of the court fee. The fee must be paid by cash, certified check, money order or bank check. Personal checks will not be accepted.

Whenever you ask a court to step into a dispute involving an arbitration, you have to file a type of suit called a special proceeding. The court will schedule a hearing on your request and, unless circumstances warrant a court's refusing to confirm the award, the court will issue a judgment confirming the award.

Petitions MUST be signed in the presence of a Notary Public or a Family Court Clerk.
