Alimony ends when either spouse dies, when the date set in the alimony order passes, or if the dependent spouse remarries or moves in with a new partner. The court can also change the amount of alimony or stop it completely if either spouse experiences a change in life circumstances.

Upward Modification of Spousal Support The recipient of spousal support can petition for upward modification by showing significant change in circumstances such as loss of employment, disability or illness and any financial emergency.

N.C. Gen. Stat. § 50-16.7(j) provides that an alimony order is enforceable by civil contempt and that its disobedience is punished by criminal contempt. Consequences for the non-paying spouse can be severe and may include wage garnishment, property liens, and even jail time in extreme cases.

Spousal support is available to economically dependent spouses in North Carolina. Either spouse may be eligible for alimony if they are unable to meet their own reasonable financial needs or maintain their standard of living during the marriage without the other spouse's income or assets.

In most cases, the court will award alimony for the duration of half the length of the marriage. For example, if a couple was married for 10 years, the dependent spouse would get 5 years of alimony. But, the court may deviate from this at any time depending on the circumstances of each spouse.
