It is a crime to knowingly write a check that will bounce. You could be charged with a misdemeanor or a felony for writing bad checks. Avoid writing a check for an amount that is greater than what's in your account.

A check or order of $1,000 or more but less than $75,000 is a misdemeanor of the first degree. You can be sentenced to up to five years in jail and a fine up to $5,000. It is a felony of the third degree if the check or order is $75,000 or more.

The bank will "bounce" the check if you write a bad one because there are insufficient funds in your account to cover it. It will decline to pay the amount. But some individuals write and try to pass checks even though they know there's not enough money in their accounts to cover them.

§ 4105. Bad checks. (1) A person commits an offense if he issues or passes a check or similar sight order for the payment of money, knowing that it will not be honored by the drawee.

1st Degree Misdemeanor: Punishable by up to 5 years in prison if check is $1,000 or more but less than $75,000, or if you pass a bad check of any amount less than $75,000 and it is your 3rd offense within 5 years. 3rd Degree Felony: Punishable by up to 7 years in prison if check is $75,000 or more.

After you find out that the check bounced, contact the bank. Even though the check bounced at one time, there might be sufficient funds now. Ask if the bank can try depositing the check again. If there still aren't sufficient funds in the customer's account, ask the bank if they can do an enforced collection.
