A holographic or handwritten will is valid in Mississippi if it's testamentary in character (i.e. intended to be a will, not just a letter to a friend) and is wholly written, dated, and signed by the testator or creator of the will.

Mississippi law holds that a will entirely written in the testator's handwriting and signed at the end (a ?holographic? will) is a valid will. Otherwise, Mississippi Code Section 91-5-1 establishes the following requirements for a valid will or codicil.

Notarization Requirements in Mississippi. Unlike some other states, Mississippi does not explicitly require living wills to be notarized. The Mississippi Advance Health-Care Directive Act allows individuals to create a living will without the need for notarization or witnesses.

§ 91-5-1, anyone at least 18 years old and of sound mind can create a will. The testator must sign the will or direct another person to sign it in the testator's presence. However, if the testator does not completely write the will, at least two credible witnesses must attest to the will in the testator's presence.

The laws are different in each state; however, in Mississippi, your Living Will requires notarization or the signatures of two witnesses. At least one of the witnesses to your Living Will form should not be a relative, spouse, adopted child, heir, or any other beneficiary.

Wills in Mississippi don't need to be notarized to be valid, but notarization can make the probate process smoother. That's because, when a will is notarized, it means the probate court doesn't have to summon the witnesses to make sure the will is legally binding.
