The Modification Process In order to modify said orders, parents need to demonstrate that relevant circumstances have changed to such a degree that the current orders no longer support the children's best interests. The standard here is what the courts call a material change in circumstances.

First, you can request that the other party be compelled to comply with the family court order by filing a Motion to Enforce. This motion asks the judge to (1) compel the non-compliant party to follow the court order and (2) award relief to the party filing the petition. Second, you can pursue a Petition for Contempt.

If you already have a court order for custody or visitation, you can request the court to change custody or visitation. To do this you may: (1) obtain the services of an attorney to handle your case; or (2) file the case yourself by using the Domestic Relations forms.

Maryland is one of many states that allow a child to weigh in with their preferences at 16 years of age. It also allows children 16 years and older to petition the court for a change of custody if they're not happy with the arrangement ordered in the initial decree.

Qualifying material changes to child custody arrangements may include: Interfering with court-ordered visitation. Moving out of state. Inability to comply with the previous order. Misuse of custody funds. Assault, abuse, or other violence. Dangerous home situations. Dramatic shifts in a child's behavior.
