To expunge a Massachusetts criminal case, you must show that some serious error or fraud has led to you being incorrectly identified as the the accused person. This is different from being not guilty of an accusation. This means that the court has mistaken you as the person that should be charged with a crime.

A Petition to Seal must be submitted to the Commissioner of Probation. If the request to seal records is granted, the Commissioner will notify all other relevant agencies to seal the record. Sealing conviction records You can ask to seal a criminal record under these circumstances: Misdemeanor ? 3 years after you were found guilty or after any jail or prison time, whichever date is later. If the offense is a felony, you must have completed all parts of your sentence at least 7 years ago. If the offense is a misdemeanor, you must have completed all parts of your sentence at least 3 years ago.

In the case of a misdemeanor, complete and submit CR-180 California Penal Code section 1203.4a states the requirements of expunging a California misdemeanor, including completing and submitting form CR-180, the Petition for Dismissal. Note that you must submit the petition for expungement in the county of conviction.
