Beginning July 1, 2023, there is a rebuttable presumption that equal timesharing is in the best interest of the child. A parent who wishes to rebut this presumption has the burden of proving by a preponderance of the evidence that equal timesharing is not in the child's best interest.

In Florida it is rare for either parent to get sole parental responsibility and custody. However, it is not impossible.
