Texas Vital Statistics cannot send out Acknowledgement of Paternity forms to applicants. Instead, the forms can only be obtained from someone certified by the Texas Attorney General's office to verbally explain to all the parties the rights and responsibilities that come with signing the form.

In Texas, signing a birth certificate to establish paternity is not enough by itself. An unwed father must sign a voluntary acknowledgment of paternity (AOP) which acts as a document that legally establishes paternity between the father and the child.

If the mother was unmarried at the time of the child's birth and no other name is listed on the certificate of birth as the father, the biological father's name may be added to the birth certificate by filing an Acknowledgment of Paternity Statement form. An AOP is usually used when the parents aren't married but agree on the identity of the child's father. When the completed AOP is filed with the Texas Vital Statistics Unit, the genetic father becomes the child's legal father with all the rights and duties of a parent.

In Texas, Vital Statistics maintains the statewide Paternity Registry, Acknowledgement of Paternity (AOP) records, and reports of court cases affecting the Parent-Child relationship. The process to establish paternity is carried out by the Texas Attorney's General Office.

To complete and file an AOP, both parents must work with an AOP-certified entity. AOP-certified entities have been trained by the Office of the Attorney General to help parents voluntarily establish paternity.
