Establishing paternity only comes with a time limit if that child already has a presumed father, who is not you. This time limit is four years after the birth of that child, as specified on their birth certificate. However, there are exceptions to this period of four years.

In Texas, signing a birth certificate to establish paternity is not enough by itself. An unwed father must sign a voluntary acknowledgment of paternity (AOP) which acts as a document that legally establishes paternity between the father and the child.

When the mother and father disagree about paternity or just want to make sure of the biological father, the Office of the Attorney General may file a petition asking that the court establish an alleged father as the biological father. In this case, the court will often order the alleged father take a paternity test.
