Failure to Make Payments If the non-custodial parent chooses not to comply with the Order to Show Cause and fails to make the required payments, they may be found in contempt and sentenced to serve a period of time in jail. The finding of contempt and the length of time spent in jail are decisions for the court.

The Court requires a civil cover sheet (available from the Clerk's Office) and a complaint that includes an original signature and your address. You must also either pay the filing fee or request the Court to allow you to file the case without paying the filing fee.

Nonsupport may be charged as a felony if the obligated parent fails to pay six months within a twelve-month period or has accumulated an arrearage in excess of five thousand dollars.
