You can not file guardianship on your own child unless the other parent is deceased. The filing fee for a Relative Guardianship is $77.00. The filing fee for a Non-Relative Guardianship is $201.64.

Short-Term Guardianship You only need a guardianship for a minor child for 6 months or less; AND. The parents will sign and notarize a short-term guardianship agreement. Only one parent's signature is needed if the other parent is deceased, unknown, has no legal rights, or has had their parental rights terminated; AND.

In Oklahoma, to obtain a guardianship over your relative, file a petition for guardianship in the district court of the county in which your relative lives. Then, ask the judge to set a hearing on the matter. You will have to give notice of the hearing to certain other relatives of your relative.

When petitioning for an emergency guardianship, the petitioner must prove that the adult is unable to make decisions or adequately care for themselves. Additionally, there must be evidence of imminent risk if a guardian isn't appointed right away.
