Even where a non-Canadian judgment is final and the foreign court properly had jurisdiction, a judgment debtor can argue that a non-Canadian judgment should not be enforced on grounds of (a) public policy; (b) fraud; or (c) a lack of natural justice.

At common law, a foreign judgment may be recognised if: it is a final judgment (although this requirement has been waived in certain limited circumstances); it was granted by a court of competent jurisdiction; and. it is of a nature that the principle of comity requires the Canadian court to enforce.

Object of Section. The judgment of a foreign court is enforced on the principle that where a court of competent jurisdiction has adjudicated upon a claim, a legal obligation arises to satisfy that claim.
