An unrepresented party may file a new civil case by emailing, mailing, or delivering the cover sheet and initiating documents to the Clerk's Office. Prepare the Civil Cover Sheet and initiating documents (e.g., complaint, petition, notice of removal).

A small claims case must be filed in the justice court where the defendant resides or where the claim arose (where the events happened). If the defendant resides or the claim arose within a municipality and if the municipality has a justice court, file the case in the municipal justice court.

In Utah, the court will usually not consider a child's preference unless they are 14. However, the child's preferences are not the only factor the court finds. The judge may place more weight on the child's wishes if they are 16 or older.
