A summons is a court form which notifies the defendant that they are being sued and lists the day the defendant needs to appear in court (the Return Date). The court has no power to hear a case until the defendant is served the summons and complaint. The plaintiff selects both the Return Date and the trial date.

In addition to filing the answer with the court, the defendant must deliver a copy of the answer to the other party (or their attorney, if they are represented by an attorney). The defendant can email, mail or hand deliver the answer. Utah Rule of Civil Procedure 5 governs the service of an answer.

An unrepresented party may file a new civil case by emailing, mailing, or delivering the cover sheet and initiating documents to the Clerk's Office. Prepare the Civil Cover Sheet and initiating documents (e.g., complaint, petition, notice of removal).

How the papers can be served Mailing them to the last known address provided. Handing them to the person. Emailing them to the most recent email address provided. Leaving them at the person's office with a person in charge or in a receptacle meant for deliveries.

A summons is an official notice of a lawsuit. It is given to the person being sued. If you sue someone, they need to know about it. This way, they can come to court and fight the lawsuit.
