An ongoing child support obligation can be modified when there is a change in circumstance between when the support order was entered and current circumstances. One of the types of changes in circumstances is when a parent receives a raise, changes positions, or is promoted.

The basic forms are the divorce complaint, marital settlement agreement, testimony of plaintiff (affidavit), affidavit of residency, child support information sheet (CS-47), and the vital statistics form. You must file the uncontested divorce documents with the clerk of the court and pay a filing fee.

Either parent can petition the court for a modification of child support. For example, depending on the change in circumstances, you could ask the court for more support or to pay less. When petitioning the court, you must have evidence to show the change in child support is warranted.

Rule 32 was amended effective June 1, 2023, to provide a method of calculating child support in cases in which a court order provides for shared 50% physical custody, i.e., when each parent retains physical custody of a child 50% (or approximately 50%) of the time.

The obligation of each parent is computed by multiplying the total child support obligation by each parent's percentage share of their combined adjusted gross income. The custodial parent shall be presumed to spend his or her share directly on the child.

DHR will only review orders once every 36 months, unless a significant change such as a financial windfall or a severe medical crisis occurs. The request must be made in writing and state why you believe the order should be changed.
