A power of attorney (POA) authorizes someone else to handle certain matters, such as finances or health care, on your behalf. If a power of attorney is durable, it remains in effect if you become incapacitated for any reason, including illness and accidents.

Colorado law does not require a power of attorney to be witnessed or notarized. Despite the law, it is considered best practice to have the document signed, notarized, and witnessed by two people. Why? The signature is presumed to be genuine if the power of attorney is notarized.

File a Copy With the Recorder's Office If you initialed "real property," giving your agent the power to conduct transactions with real estate, you should also file a copy of your POA in the land records office (called the clerk and recorder's office in Colorado) in the county where you own real estate.

You must require the signer (called the principal) to be physically present, identify this signer ing to Colorado law and complete a full journal entry for the notarization. Colorado law requires all documents to be complete, so you must check for any blank spaces before you notarize the document.

An entry of appearance shall state (a) the identity of the party for whom the appearance is made; (b) the attorney's office address; (c) the attorney's telephone number; (d) the attorney's E-Mail address; and (e) the attorney's registration number. (2)Withdrawal From an Active Case.

This power of attorney authorizes another person (your agent) to make decisions concerning your property for you (the principal). Your agent will be able to make decisions and act with respect to your property (including your money) whether or not you are able to act for yourself.
