Amendments to a trademark application in India can be made by filing a request with the Indian Trademark Registry. The applicant needs to file the request as per form prescribed under the Trade Marks Act, 1999. The prescribed forms are: Form TM-M if the Trademark application is pending for registration.

The application for registration of trademark must be made in the prescribed manner and filed along with the fee for trademark registration. Trademark application can be filed at one of the five Trademark Registrar Office having jurisdiction over the State or online.

The duration of a Mark registration is five years from the date of registration. A Mark may be renewed for another five years by filing a Mark renewal form within six months of the expiration date.

Renewal of a Trademark The renewal can be filed within one year prior to the date of expiry as per rules 57 and 58 in Trade Mark rules 2017. The renewal can be filed within six months prior to the date of expiry as per rules 63 and 64 in Trade Mark rules 2002.

As per the Trademark Act of 1999, the period of trademark registration in India is 10 years. A TM renewal for another 10 years will be done after completing the initial registration period. TM renewal petitions must be filed 6 months prior to the expiration date.
