A special warranty deed guarantees two things: The grantor owns, and can sell, the property; and the property incurred no encumbrances during his ownership. A special warranty deed is more limited than the more common general warranty deed, which covers the entire history of the property.

It is called a ?Warranty? Deed because the Seller who signs the deed is making a warranty [promise] that the Seller owns the property and that the property is clear of liens and other problems that are not stated in the deed.

While the seller in a Warranty Deed must defend the title against all other claims and compensate the buyer for any unsettled debts or damages, the seller in a Special Warranty Deed is only responsible for debts and problems accrued or caused during his ownership of the property.

A Utah special warranty deed allows for the ownership transfer of real estate with the guarantee that no claims have been made during the grantor's period. The grantee will be responsible for any claims made prior to the grantor's ownership.

A Texas warranty deed form allows Texas property owners to transfer real estate with a full warranty of title. A person who signs a warranty deed (the grantor) guarantees that he or she owns the property and has the right to transfer clear title to the new owner (the grantee).

In Utah, ownership of real property, land and water rights, is transferred by a written and signed conveyance typically a deed. Prescribed forms of Quit Claim, special warranty and Warranty deeds are found in the Utah Code, ?see UCA §57-1-12, 12.5 and 13.
