Couples do not have to be legally separated before filing for divorce in Colorado, and in fact, some divorces are started while the parties are still living together. If tensions are running high in the home, we often recommend that one of the parties move out while the divorce is pending.

Since 1995 the Office has worked with the parties in nearly 600 mediations. Over 80 percent of those cases have resulted in an agreed settlement. Mediation is generally voluntary, although on occasion a judge will order parties to engage in ADR.

Colorado Revised Statute § 13-22-307 protects the confidentiality of information disclosed in mediations unless all parties consent otherwise, with the exception of a few extreme circumstances. However, mediation Page 4 agreements are legally binding, admissible in court and may be enforced by a court.

Some Colorado courts require divorce mediation before any court hearing, while others do not. Whether or not you and your spouse are required to mediate, it is better to self-refer to mediation early on, while workable options are still available and before disputes intensify.

Step 2: Come to An Agreement if Possible The spouses may file a joint petition. The divorce may become final in 91 days, which is the statutorily prescribed waiting period. More often, however, a divorce takes longer. In most contested cases, the process will take several months from start to finish.
