The new law's standards apply specifically to all vehicles purchased, leased or registered in Georgia on or after Jan. 1, 2009. The Georgia lemon law protects new vehicle buyers by enforcing the manufacturer's express warranty. The law does not apply to used cars.

A vehicle is deemed to have met the repair attempts requirement when it has been out of service by reason of repair for at least a total of 30 days. In this event, you count the cumulative days out of service instead of individual repair attempts. The vehicle may be out of service for the repair of one or more defects.

Pursuant to the Georgia Lemon Law [O.C.G.A. Section 10-1-791(a)], a fee of $3.00 shall be collected by every dealer from each consumer at the completion of the sale or lease of a new motor vehicle.

The new(2016-2023 model years) motor vehicle must have multiple, ongoing defects and/or issues, or 1 serious safety defect. If the vehicle has been out of service for 30 or more days, you may also qualify. The car should have had repeated, unsuccessful repair attempts by the dealer, or an authorized repair facility.

The Georgia Lemon Law is a self-help statute whose primary goal is to have the manufacturer of your motor vehicle fix any defects. If your vehicle cannot be repaired in a reasonable number of attempts and is found to be a "lemon," the law requires the manufacturer to replace or buy back (repurchase) the vehicle.
