Oregon statutes allow anyone the right to inspect any public record that is not exempt from disclosure, regardless of requester's intent. A request under the Federal Freedom of Information Act (FOIA) is fulfilled under Oregon public records law; however, FOIA time frames and provisions don't apply.

Under Oregon's Public Records Law, ?every person? has a right to inspect any nonexempt public record of a public body in Oregon. [1] This right extends to any natural person, any corporation, partnership, firm or association, and any member or committee of the Legislative Assembly.

Most public records are subject to disclosure, but there are exemptions. Records related to an active criminal investigation are exempt from disclosure until the case is resolved. Confidential communications between government officials and government lawyers are also exempt from disclosure.

On its face, Oregon's public records law sounds simple. It applies to all government records and writings. The public body must consider each request for records on a case-by-case basis. The law favors disclosure as the rule, and agencies have the burden of proving an exemption allows them to withhold information.

The Open Records Portal is an online tool that allows the public to conduct a name-based search on themselves or another individual. A $10 fee per search is required, and the report can be delivered by mail or e-mail.
