Generally speaking, the quit claim deed must clearly identify the grantor and grantee, and state that one is conveying and quitting claim to the other. The form is also not complete and valid without a complete legal description of the property; all documents must be formatted properly, signed properly, and notarized.

Prior to signing a quitclaim, you will want to make sure that you and your spouse have a fully executed Marital Settlement Agreement (MSA) that has been signed by both parties. Once a quit claim deed is signed, then the party transferring their rights will have no claim to the home.

In order to change the name on your deed, a new deed must be prepared. The Recorder of Deeds Office is unable to provide legal advice or opinions and we do not have blank forms. Additionally, paperwork must be fully completed and notarized before bringing it to our office to record.

A quitclaim deed must also be correctly formatted, signed, and notarized, and it must contain (among other things) a tax address, the document preparer's name, and the appropriate transfer tax information. If the deed passes title to multiple new owners, it must identify the co-ownership form they will use.

In addition to the signature of the grantor(s), deeds should be acknowledged. Even though Illinois law does not require acknowledgement, 765 ILCS 5/20 provides several ways to acknowledge a deed, including acknowledgement before a notary public.

LEGAL FEES - ILLINOIS QUIT CLAIM DEEDS The fee is $150 (or $160 if paid by credit card). It will be your responsibility to get the transfer stamps (if necessary) and get the deed recorded with the County Recorder. There is nothing legal about obtaining the municipal stamp and recording the deed.
