How Long Does an Eviction Stay on Your Record? An eviction itself doesn't appear on your credit report. However, any unpaid rent and fees could be sent to collections and remain on your credit report for seven years from the original delinquency date.

Your landlord must send you a "14-Day Notice to Quit" if terminating your tenancy for non-payment of rent (M.G.L. c. 186, § 12). If it is being terminated for any other reason, you must be given written notice 30 days, or one full rental period in advance, whichever is longer.

Under a lease, you can give a tenant a 14-day notice to quit for non-payment, and a 7-day notice for other reasons if they are already written into the lease. These reasons include guns, drugs and prostitution. If your tenant does not have a lease, they are a tenant at will, and the rules are a little different.

The landlord or tenant can end a month-to-month tenancy-at-will by giving a written 30 days (minimum) notice to quit that must expire at the end of a rental period. Pay special attention if the notice to quit is given in February, which has less than 30 days.

Tenants under lease If you are evicting the tenant for nonpayment, you must send a 14 day Notice to Quit (M.G.L. c. 186, § 11).
