Everyone has the right to use a name of their choice as long as it is not done for fraudulent or illegal purposes. However, if you want to change your name on your birth certificate, you must submit a court name change decree at the same time that you are applying for a gender change.

Changing Names After Marriage: You must fill out the appropriate forms requesting the change and produce your marriage certificate to have your surname changed on your passport or driver's licence. Your marriage certificate will also be accepted as proof by financial institutions like banks and building societies.

Your name is automatically changed to the one listed on your certificate after your wedding. After you get a copy of your marriage certificate, you can apply for identification with your new name, including a Social Security card, Massachusetts driver's license, and U.S. passport.

If you have a good reason for the notice not being published, you can file a Motion (CJD 400) to waive publication. An affidavit (a sworn statement) must be filed with the motion explaining why you don't want the notice published. You may have to go before a judge to present your reasons.

To file a petition with the Probate and Family Court, the individual must first fill out the Petition to Change Name of Adult (CJP 27). This form requires the petitioner to provide their current name, address, the proposed new name, and an explanation of why they want to change their name.
