The Arkansas Water and Air Pollution Control Act of 1949 makes it unlawful to ?cause pollution . . . of any of the waters of this state,? or to ?place or cause to be placed any sewage, industrial waste or other wastes in a location where it is likely to cause pollution of any waters of this state.?

As amended in 1972, the law became commonly known as the Clean Water Act (CWA). The 1972 amendments: Established the basic structure for regulating pollutant discharges into the waters of the United States. Gave EPA the authority to implement pollution control programs such as setting wastewater standards for industry.

The CWA is the principle law governing pollution control and water quality of the Nation's waterways. The object of the CWA is to restore and maintain the chemical, physical and biological integrity of the Nation's waters (33 U.S.C. 1251).

The Clean Water Act (Wikipedia Article) requires states to develop and maintain water quality standards. The Arkansas Department of Environmental Quality (ADEQ) uses monitoring data to assess the waters of the state.

As well as giving you the right to access environmental information, the AIE Regulations also oblige public authorities to be proactive in disseminating environmental information to the public. Public authorities must inform the public of their rights and provide information and guidance on exercising those rights.

Information that would inform the public about matters affecting the environment or enable them to participate in decision-making is likely to be environmental information, even if the information does not directly mention the environment.
