Acknowledgment of Paternity Affidavits executed in the hospital at the time of birth are submitted to the Vital Records Registry with the birth record by hospital staff. They are processed and filed without charge. Your child's birth certificate will reflect the name and paternity information shown on the Affidavit.

B. If the child is born to a mother who neither is married nor was married within three hundred days prior to the birth of the child, the full name of the father who has acknowledged his child by authentic act shall be included on the birth record of the child, but only if the father and mother agree.

The above statutes state the contents required to be provided in the birth certificate. Both parents listed on the birth certificate must sign the affidavit in the presence of a licensed notary. This form cannot be used to change a child's last name. A child's last name can be changed by an Acknowledgment of Paternity Affidavit or a court ordered change of name from a Louisiana court.

A man may, by authentic act or by signing the birth certificate, acknowledge a child not filiated to another man. The acknowledgment creates a presumption that the man who acknowledges the child is the father. The presumption can be invoked only on behalf of the child.
