Here are the steps for officially filing for custody in Louisiana: Filing a petition or motion for custody. Serving the petition to the opposing parties. Receiving an answer, opposition, or countermotion. Hearing or trial.

If there is no child custody order in place, relocation is defined as moving the child more than 75 miles from the other parent's residence or out of state. Only a parent who has sole custody, primary physical custody or equal physical custody can seek relocation with the children.

Temporary custody is only good for a limited time period and may only be extended for an additional 15 days by the court. During that time period the court must conduct a full hearing, to determine if the custody should remain with you. The time period depends on the type of temporary custody you request.

On a temporary basis, this form may be the simplest solution. How is it done? A Provisional Custody by Mandate is done by affidavit. The form is signed by the parents and you in front of a notary and two witnesses.

A petition for voluntary transfer of custody shall set forth specifically: (1) The name and address of all parents and legal custodians. (2) An affirmation that the parents are knowingly and voluntarily transferring custody. (3) The full name and date of birth of the child whose custody is sought to be transferred.

The child's parent(s) must be living and must want you to take care of the grandchild. This is known as Provisional Custody by Mandate under Louisiana law. Provisional custody lasts for one year at a time. It can be renewed by the grandparents and parents of the child on an annual basis.
