Legal guardianship means a court grants someone other than a biological parent the right to care for a minor. Custody (most often) generally describes a parent caring for his or her own child. Guardianship does not always grant custody or definitively mean a biological parent's custody is revoked.

Supported Decision Making is an alternative to guardianship where a person selects supporters to assist the person in the decision-making process. It is a process of supporting or accommodating an adult in the decision-making process to promote greater self-determination.

An emergency guardianship is temporary, lasting for no longer than 60 days, but can be ordered by a court without holding a hearing first. To establish permanent guardianship, the parties must have a hearing first. If the judge rules in favor of guardianship, it will last as long as needed.

File a Petition for Guardianship with a court with probate jurisdiction and notify the allegedly incapacitated person, all close family members, and any person or institution having care or custody of the allegedly incapacitated person during the 60 days preceding filing of guardianship petition. VASIA Programs In 2023, we awarded $1.3 million in matching funding to 20 volunteer-based guardianship programs, serving 52 counties. These VASIA programs currently assist over 800 vulnerable adults in Indiana who do not otherwise have suitable family or others to provide for their care.

A guardian for the child's estate will need to be represented by an attorney who will assist with filing the correct court documents. Court procedures are different in each of Indiana's 92 counties.
