They can allocate their resources, advertise the property extensively, utilize various marketing channels, and leverage their network to maximize exposure.

To avoid such predatory practices, California enacted Civil Code 1670.12 and Government Code 27280.6, which took effect January 1, 2024, prohibiting an exclusive listing agreement to last longer than 24 months or to renew such a listing for longer than 12 months.

The crucial things that must be included in this type of agreement are the start and end date for the listing period. This is to ensure clear terms for when the agreement is active and when it is not. A protection clause may also be included, but it is not necessarily a required element.

While this agreement is active, the property owner cannot use another agent.

In an exclusive agency listing, the seller retains the right to sell the property, with no obligation to the broker. With exclusive right-to-sell listings, the broker receives a commission regardless of who sells the property.
