You are allowed to conduct construction on your property between 7am and 6pm on weekdays. At all other times, including anytime on the weekends, you must apply for after-hours authorization.

Construction noise is covered by Chapter 12.08. 440 in Title 12 of the County Codes. Most construction must take place between a.m. and p.m. during normal weekdays. However, emergency repairs may be performed as necessary.

Residential Construction is allowed between 7 AM and 6 PM on weekdays. Alterations or repairs to existing one-family or two-family, owner-occupied dwellings, convents or rectories may also be performed on Saturdays and Sundays between AM and PM.

A motion may be withdrawn at any time prior to its return date by filing with the clerk a written request signed by counsel for the moving party. A request to withdraw a motion after submission must be supported by a stipulation of withdrawal signed by all counsel.

The return date is the court date. The party making the motion chooses the court date and puts it in the Notice of Motion so everyone knows when to come to court. NYSCEF wants to know the court date and has a calendar button to find the court date you picked.
