Construction noise is covered by Chapter 12.08. 440 in Title 12 of the County Codes. Most construction must take place between a.m. and p.m. during normal weekdays. However, emergency repairs may be performed as necessary.

Construction work should be restricted to the following hours: Monday to Friday 8am – 6pm. Saturdays 8am – 1pm. Avoid noisy work on Sundays and Bank Holidays.

You are allowed to conduct construction on your property between 7am and 6pm on weekdays. At all other times, including anytime on the weekends, you must apply for after-hours authorization.

Sometimes night work is an ease of access thing too. Roads with high enough volumes they won't bother working on during the day for the sheer chaos it could end up creating. I think they're required to give residents a heads up though if it's planned in advance, as that type of work would be (vs emergency work).

If the landlord does not agree then you can sue your landlord for a breach of the implied warranty of quiet enjoyment and ask the judge to let you out of the lease and/or for monetary compensation. You can do this at your local small claims court.

Luckily, the noise laws in NYC set a more enforceable standard in order to reduce unreasonable noise coming from refuse collection vehicles. Quiet Hours NYC- Again, ing to local laws, quiet hours in NYC are from 10 pm to 7 am. There can be fines in place for those found violating these laws.

Essentially, construction work must be carried out between 7am and 7pm Monday to Saturday.

Commercial, Street, and Highway Construction is allowed on weekdays between 7 AM and 6 PM. However, emergency work necessary for public safety, or work that cannot be performed during normal work hours may occur after hours or on weekends.

Residential Construction is allowed between 7 AM and 6 PM on weekdays. You are allowed to conduct construction on your property between 7am and 6pm on weekdays.The first line of complaint is to call 311 or report it at nyc.gov. One call may not help, but they do collect and tally complaints. Performed outside of a fully enclosed structure after pm or before am on weekdays or before am on weekends and national and state holidays. It shall be unlawful to engage in or to cause or permit any person to engage in construction work other than on weekdays between the hours of 7 am and 6 pm. In Albany, construction and power equipment noise is prohibited between pm and am. There are various noises that are are just plain illegal. Construction and demolition activity, excluding emergency work, shall not be performed between the hours of pm and am on weekdays. On January 18, 2018, Mayor de Blasio signed into law new NYC construction noise requirements due to the dramatic increase in after-hours noise complaints.
