If you have worked less than 6 hours in a day, you can agree to forego your meal break. You can also agree to take your meal break while on duty.Employers must provide a second meal break of no fewer than 30 minutes for all workdays on which an employee works more than 10 hours. California workers are entitled to be relieved of all duty during 30 minute meal breaks. The mission of the California Labor Commissioner's Office is to ensure a just day's pay in every workplace in the State and to promote economic justice. If you work over 5 hours in a day, you are entitled to a meal break of at least 30 minutes that must start before the end of the fifth hour of your shift. Paid breaks required for every four hours (or "major fraction thereof") worked. Under wage and hour law, non-exempt employees need to get a 30-minute lunch or meal break if they work beyond five hours in one day. If disaster conditions prevail every effort will be made to contact needed employees for return to their work station. Employees earn one hour of paid sick leave for every 30 hours of work they complete.
