Under the California Labor Code, “minor” means any person under the age of 18 years who is required to attend school under the provisions of the Education Code, and includes minors under age six.

Breaks: While there is no specific state law requiring breaks for minors, federal law (FLSA) requires that if an employee works more than 5 consecutive hours, they must be given a break of at least 30 minutes. So, if a 16-year-old is working 8 consecutive hours, they must be provided with at least a 30-minute break.

Emancipation is the process of a parent giving up control over a minor child so that the child has control over his own legal decisions and support before he is an adult (age 18). In New York, a parent must financially support his/her child until age 21 unless the child becomes emancipated.

Minors 14 and 15 years of age‍ They may work between the hours of 7 a.m. and 7 p.m. They may not work during school hours.
