Georgia law does not require private employers to provide employees with either paid or unpaid holiday leave. Under FMLA, eligible employees in Georgia can take up to 12 weeks of unpaid leave for 12 months. Working on weekends and holidays is also considered overtime. Georgia law does not require private employers to offer paid vacation time. Full-time public employees receive 15 days (3 weeks) of sick leave, with a maximum accrual of 90 days (720 hours). If you have to work on one of the federal holidays, your employer may offer holiday pay to motivate employees to not take the day off without pay. That means any nonexempt employee working above 40 hours in a workweek is entitled to receive overtime pay.
