Fair dismissal refers to the lawful termination of an employment contract, where the reasons for dismissal are justifiable and the process is carried out in ance with established legal standards.
What is dismissal? Dismissal is when an employer terminates a contract of employment under fair or unfair, grounds. It's necessary for employers to meet certain requirements before they can dismiss an employee. Employees who have their contract terminated also have rights to protect them from unfair dismissal.
Section 186 of the LRA provides the meaning of dismissal by describing six types of circumstances which may be defined as a “dismissal”: Where an employer terminates employment summarily, without notice or by conduct, or terminates employment by giving an employee notice.
Wrongful termination occurs when an employer fires a worker for unlawful reasons.
