California Current Dollar Amounts Under Code of Civil Procedure Section 699-730b, also known as the Civil Code Statutory Amounts, are monetary amounts that are updated periodically to keep pace with inflation and other economic factors. These amounts are used to set limits on certain types of damages in civil cases in California. The California Current Dollar Amounts are updated on an annual basis and currently include the following: • Maximum amount for compensatory damages for wrongful death: $250,000 • Maximum amount for punitive damages for wrongful death: $1,000,000 • Maximum amount for medical malpractice damages: $250,000 • Maximum amount for attorney’s fees for the prosecution of a claim for wrongful death: $10,000 • Maximum amount for attorney’s fees for the prosecution of a claim for medical malpractice: $50,000 • Maximum amount for attorney’s fees for the defense of a claim for wrongful death: $5,000 • Maximum amount for attorney’s fees for the defense of a claim for medical malpractice: $25,000 • Maximum amount for individual liability in a class action: $500,000 • Maximum amount for aggregate liability in a class action: $2,000,000 • Maximum amount for attorney’s fees for the prosecution of a class action: $10,000 • Maximum amount for attorney’s fees for the defense of a class action: $5,000
