California Notice and Request for Ruling — Habeas Corpus is a form used to request a ruling from a court on whether a person is being unlawfully detained or denied a right to a fair trial. This form is used to challenge the legality of a person’s confinement or detention, usually for the purpose of obtaining a writ of habeas corpus, which orders the jailer or other custodian to produce the detained person before the court to determine whether they are being held lawfully. There are two types of California Notice and Request for Ruling — Habeas Corpus: 1) Petition for Writ of Habeas Corpus; and 2) Application for Writ of Habeas Corpus. The Petition for Writ of Habeas Corpus is used when a person is being held in custody or otherwise detained and is challenging the legality of the confinement. The Application for Writ of Habeas Corpus is used when a person has been released from custody or otherwise detained and is seeking a ruling to affirm that the release or detention was lawful.
