The California Juror Questionnaire for Criminal Cases — Capital Case Supplement is a questionnaire used by the court to assess prospective jurors’ views on capital punishment. This questionnaire is used to assess the ability of prospective jurors to be impartial in the sentencing phase of a capital case. The questionnaire consists of three parts—Background and Attitudes; Death Penalty Cases; and Void Dire Questions. The first part, Background and Attitudes, asks questions about the prospective jurors’ knowledge and beliefs regarding the death penalty and their willingness to consider it as a sentence in a capital case. Questions in this section address topics such as the prospective jurors’ opinion of the death penalty and their knowledge of the applicable law. The second part, Death Penalty Cases, asks more detailed questions regarding the prospective jurors’ familiarity with death penalty cases, specific views on the death penalty, and opinions on the types of evidence that should be considered when deciding a capital case. The final part, Void Dire Questions, includes questions related to the prospective jurors’ ability to serve on a capital case jury and their understanding of the legal process. This section also includes questions concerning the prospective jurors’ ability to be impartial and follow the judge’s instructions. The California Juror Questionnaire for Criminal Cases — Capital Case Supplement is used by the court to determine the suitability of prospective jurors in capital cases. If a prospective juror is found to be unsuitable, they may be dismissed from the jury pool.
