The Delaware Petition to Rescind Guardianship is a legal document that is used to request a court to terminate a guardianship. The document is initiated by a party who wants the guardianship of a minor or an incapacitated adult to be rescinded. The Petition should include the petitioner's name and address, the respondent's name and address, the name of the person who is under guardianship, the court where the guardianship was granted, the grounds for rescission, and the petitioner's signature. There are two types of Delaware Petition to Rescind Guardianship. The first type is used when the guardianship is no longer needed due to the ward’s rehabilitation, the death of the ward, or the ward has reached the age of majority. The second type is used when the guardianship should be rescinded due to the guardian's incapacity, neglect, misconduct, or other cause, such as the guardian has abandoned the ward.
