The Florida Declaration of Domicile is a legal document that establishes an individual as a resident of the state of Florida and declares their intent to remain in the state permanently. It is used to establish the individual’s legal domicile in the state, which is necessary for a variety of reasons, including tax purposes, legal rights, and estate planning. There are two types of Florida Declaration of Domicile: “Declaration of Domicile” (also known as Form DR-312) and “Declaration of Domicile for Married Couples” (also known as Form DR-312A). The Declaration of Domicile is used by individuals, while the Declaration of Domicile for Married Couples is used by married couples who wish to establish a joint domicile in the state of Florida. Both forms are available online from the Florida Department of State. In order to complete the form, individuals must provide proof of their physical presence in the state and must also declare that they have taken actions to become a permanent resident of the state, such as registering to vote, obtaining a Florida driver’s license or ID, and registering motor vehicles. The form must then be signed in the presence of a notary public and submitted to the local Clerk of the Circuit Court.
