Illinois Order Prove Up is a legal procedure used to finalize a divorce in the state of Illinois. The process is initiated when one of the divorcing parties submits a Petition for Dissolution of Marriage to the court. The Order Prove Up process starts when the court issues an Order Prove Up that requires the parties to appear in court to present evidence and testimony to support their divorce agreement. The Order Prove Up hearing is a final step before the judge signs the divorce decree. There are two types of Illinois Order Prove Up hearings. The first type is an uncontested hearing, in which both parties agree to the terms of the divorce and agree to appear before the judge to confirm their agreement. The second type of hearing is a contested hearing, in which one or both parties disagree with the terms of the divorce and must present evidence and testimony to the judge to prove their case.
