Indiana Request to Proceed in District Court Without Prepaying the Filing Fee (Prisoner) is a legal procedure wherein an incarcerated individual may request permission from the court to proceed with their case without prepaying the filing fee. This request is often referred to as an formma pauperis” request, which is Latin for “in the form of a pauper.” It can be used to file civil suits, criminal cases, and appeals. There are two types of requests: a “Motion to Waive Filing Fee” and a “Motion for Leave to ProceedFormormPaupersis.” To be granted leave to proceeformma paupers, the individual must provide an affidavit of indigence and meet certain criteria, such as having a limited or no income, not having the financial resources to pay the filing fee, and other factors determined by the court. If the motion is granted, the prisoner may proceed with their case without having to pay the filing fee.
