A Minnesota Request for Continuance, also known as an “R.F.C.”, is a legal document used in the state of Minnesota to request a delay or postponement of a court hearing. This document is used when a party in a case is unable to attend a hearing or trial on the scheduled date. It can also be used when a party needs additional time to prepare for a hearing or trial. There are two types of Minnesota Requests for Continuance: a stipulated request and a non-stipulated request. A stipulated request is a motion in which both parties agree to the continuance. This type of request requires the approval of the court and is usually granted. A non-stipulated request is a motion in which one party requests a continuance and the other party does not agree. This type of request is typically more difficult to obtain and requires the court's approval. In either case, the Minnesota Request for Continuance must be filed with the court and include a statement of the reason for the request, any supporting documents, and the parties’ signatures. The court will then review the request and make a decision.
