This document is used to request a court order that prohibits the respondent (alleged perpetrator) from contact or communication with the petitioner (victim). This document is also used to request a renewal of an existing sexual assault protection order. There are two types of Nebraska Sexual Assault, Petition and Affidavit to Renew Sexual Assault Protection Order: temporary and permanent. A temporary order is effective for a set period of time, typically 30 to 90 days, and a permanent order is effective for a longer period of time, usually one year. Both types of orders are issued by a court after a hearing in which the petitioner and respondent have the opportunity to present evidence and testimony. The court will consider the evidence presented and determine whether a protection order is necessary. If the court decides a protection order is necessary, it will issue the order and provide instructions for how it must be served on the respondent.
